Order Submission & Confirmation
- Placing an order and completing payment on our website constitutes a binding sales contract under U.S. contract law.
- For customized bedding products (e.g., embroidered four-piece sets, custom-sized cooling blankets), we will send a design confirmation email with mockups within 2 business days of your order. Production will only begin after we receive your written approval.
- We reserve the right to cancel orders in the following cases:
- Insufficient inventory or product discontinuation.
- Pricing errors due to website technical issues.
- Invalid or incomplete shipping/billing information.
- Suspected fraudulent transactions (e.g., stolen credit cards).
- Failure to confirm customization details within 10 business days.
- Cancelled orders will be fully refunded within 3 business days. For customized orders cancelled after production has started, a 20% production fee will be deducted from the refund.
Product Information & Liability
- Product descriptions, specifications (e.g., four-piece set size, cooling blanket material, latex pillow firmness), and images are for reference only. Minor variations (e.g., fabric color shades due to screen display, slight firmness differences in latex pillows) are not considered defects as long as products meet CPSC standards.
- We are not liable for dissatisfaction caused by personal preferences (e.g., fabric softness not meeting expectations, latex pillow firmness not suiting neck support needs) or incorrect size selection.
- We are not responsible for damages caused by improper care (e.g., washing four-piece sets in hot water, using harsh detergents on cooling blankets, exposing latex pillows to direct sunlight for extended periods) or unauthorized modifications.
- All bedding products are designed for indoor home use; we are not liable for damages from commercial use (e.g., hotels using residential bedding beyond intended lifespan).
User Obligations
- Provide true, accurate, and complete information when placing an order (including custom design details and delivery instructions). You are responsible for delivery delays or failures caused by incorrect information.
- Do not resell our products for commercial purposes without our prior written authorization (except for authorized retailers with a wholesale agreement).
- Comply with all U.S. safety laws and regulations when using our products (e.g., following washing instructions to avoid fabric damage, keeping latex pillows away from sharp objects).
- Refrain from fraudulent activities (e.g., false defect claims, repeated returns of used bedding products). We reserve the right to refuse service to customers who violate these policies.
Intellectual Property Rights
- All content on our website (product images, descriptions, logos, bedding design sketches, custom embroidery patterns) is protected by U.S. copyright and trademark laws and is owned by Cozy Sleep Bedding USA or its authorized licensors.
- You may download or save website content for personal non-commercial use only. Unauthorized copying, modification, distribution, or reproduction of any content for commercial purposes is strictly prohibited and may result in legal action.
Limitation of Liability
- To the maximum extent permitted by U.S. law, we shall not be liable for indirect, incidental, or consequential damages (e.g., inconvenience, sleep disruption, additional costs due to delayed delivery) arising from the purchase or use of our products, provided the products meet safety and quality standards.
- Our total liability for direct damages (e.g., defective products) shall not exceed the purchase price of the affected item.
- We are not liable for order delays or failures caused by force majeure events (e.g., natural disasters, supply chain disruptions, latex material shortages, shipping carrier strikes) beyond our reasonable control. In such cases, we will offer affected customers the option of a refund or order modification.
Dispute Resolution
- Any disputes arising from the purchase or use of our products shall first be resolved through friendly negotiation between you and our customer service team.
- If negotiation fails, either party may initiate legal proceedings in the state or federal courts located in Dallas County, Texas, USA.
- These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles.
